1. Scope of Application
These Pre-Sale Terms and Conditions apply exclusively to all pre-orders (hereinafter referred to as "Pre-Sale") of products designated as Pre-Sale items via our online shop. For such orders, these Pre-Sale Terms and Conditions supersede any other general terms and conditions of our company. Our online shop is aimed exclusively at consumers. A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal personality who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

2. Contracting Party, Conclusion of Contract, Correction Options
The purchase contract within the scope of the Pre-Sale is concluded with K&K Carp Pods, a brand of K&K Carp UG. By placing the Pre-Sale products in the online shop, we make a binding offer to conclude a contract for these items under the conditions stated in these Pre-Sale Terms and Conditions. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding pre-order by using the correction aids provided and explained in the order process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the pre-order, you will receive another confirmation by email.

3. Contract Language, Contract Text Storage
The language(s) available for the conclusion of the contract: German, English, French. We save the contract text of your pre-order and send you the order data (details of your order) in text form. For security reasons, the specific contract text of your individual pre-order is no longer directly accessible to you via the internet after completion of the order process; please refer to the order confirmation sent to you for the details of your order.  

4. Delivery Conditions and Shipping for Pre-Sale Items
In addition to the stated product prices for Pre-Sale items, shipping costs will be added. You can find more details on the amount of shipping costs directly with the product offers or during the ordering process.

4.1 Estimated Shipping Date and Possible Delays
For products ordered as part of this Pre-Sale promotion, the shipping period is expected to begin around the end of May / beginning of June 2025. We expressly point out that this is an estimated and non-binding date. Due to production, supply chain, or other unforeseeable circumstances, the delivery date may be postponed indefinitely. By placing your pre-order, you agree to this possibility of indefinite delay. We will inform you about significant changes to the estimated delivery date.

4.2 Shipping Time After Start of Delivery
From the actual start of delivery of the products ordered within the Pre-Sale, the shipping time to the areas we deliver to is generally 7-14 working days. You will be informed separately about the start of delivery.

4.3 Shipping Method
We only deliver by shipping. Unfortunately, self-collection of the goods is not possible.

5. Payment Conditions for Pre-Sale Items

5.1 Full Prepayment
The full purchase price for Pre-Sale products is due immediately upon conclusion of the contract, i.e., upon completion of your pre-order, and must be paid in advance. Your pre-order will only be processed and the Pre-Sale item reserved for you after full payment has been received.

5.2 Available Payment Methods
In our shop, the following payment methods are generally available for paying for Pre-Sale items, whereby the debit or payment request occurs immediately after the order is completed:

Advance Payment: If you select the advance payment method, we will provide you with our bank details in a separate email. The goods will be reserved for you upon receipt of payment and shipped after production is complete or availability.

Credit Card: You provide your credit card details during the order process. Your card will be charged immediately after submitting the pre-order.

PayPal, PayPal Express: To be able to pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, legitimize yourself with your access data and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after submitting the pre-order. You will receive further instructions during the order process. PayPal may offer registered PayPal customers selected according to its own criteria further payment modalities in the customer account. However, we have no influence on the offering of these modalities; further individually offered payment modalities concern your legal relationship with PayPal. You can find more information about this in your PayPal account.

6. Right of Withdrawal for Pre-orders
For consumers, the following applies to pre-orders of Pre-Sale items: You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you placed the pre-order (conclusion of the contract). To exercise your right of withdrawal, you must inform us (K&K Carp UG, In der Allmende 4a, 46509 Xanten, Germany, Email: service@kkcarppods.de) by means of a clear declaration (e.g., a letter sent by post or an email) of your decision to withdraw from this contract. You can use the model withdrawal form provided on our website or sent with the order confirmation, but this is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.  

Consequences of Withdrawal for Pre-orders: If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless you have expressly agreed otherwise; in no case will you be charged any fees for this repayment.  

Note on the Statutory Right of Withdrawal: The statutory right of withdrawal, which regularly only begins upon receipt of the goods and to which you as a consumer are entitled, remains unaffected by the above regulation on withdrawal for pre-orders. 7. Warranty and Guarantees

7.1 Liability for Defects
The statutory liability for defects also applies to Pre-Sale items.

7.2 Guarantees and Customer Service
Information on any applicable additional guarantees and their exact conditions can be found with the product and on special information pages in the online shop. 8. Dispute Resolution
The European Commission provides a platform for online dispute resolution (OS), which you can find here: https://ec.europa.eu/consumers/odr/. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
